1. Using the site
You may use this site only for lawful purposes and in accordance with these terms. You must not use it in a way that breaks any law, infringes anyone's rights, introduces harmful code, or disrupts or interferes with how the site works.
We may suspend or restrict access to the site at any time without notice, for maintenance, security or business reasons.
2. Intellectual property
All content on this site, including text, graphics, logos, images, software and design, is owned by or licensed to BlueArc Technologies Pty Ltd and is protected under Australian and international law.
You may not reproduce, distribute, modify or create derivative works from it without our prior written consent, except where the law permits it.
3. Links to other websites
This site may link to other websites. We provide those links for convenience and we are not responsible for the content, accuracy or availability of anything on them. Visiting them is at your own risk and they will have their own terms and privacy practices.
4. Our website assistant
This site includes an assistant that answers questions about what we do.
It gives general information about BlueArc, and nothing more. It is not advice, it is not a compliance determination, and it is not a substitute for the judgement of a qualified person. Do not rely on anything it says to decide whether something is safe, compliant, certified or lawful.
It can be wrong. Its answers are generated, and generated answers can be incomplete or incorrect even when they read confidently. Where an answer matters to you, check it with us directly before acting on it.
Nothing it says forms part of an agreement. An answer from the assistant is not a quote, not an offer, and not a variation of any contract between us. What we are contractually obliged to deliver is set out in the proposal you accept and the terms that go with it.

5. Assessment tools, demonstrations and previews
Some things on this site are offered free, including assessment tools, walkthroughs and demonstrations, and some are made available as previews while still in development. They are provided as they are. We may change or withdraw them at any time, and we give no warranty in respect of them beyond what the law requires.
6. Disclaimer
We work to keep the information on this site accurate and current, but we do not guarantee that it is complete, reliable or suitable for any particular purpose. The site and its content are provided as they are and as available.
To the maximum extent the law permits, we exclude all warranties that are not expressly stated here.
7. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy you have under the Australian Consumer Law or any other law, to the extent it cannot lawfully be excluded, restricted or modified.
Subject to that, and to the extent the law permits, BlueArc Technologies Pty Ltd is not liable for loss or damage arising from your use of, or inability to use, this site, or from reliance on its content.
Where we are liable for a failure to comply with a consumer guarantee in relation to services, and those services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

Your use of this site is also governed by our Privacy Policy and our Cookie Policy, which explain how we handle personal information and what this site stores in your browser.
9. If you are a BlueArc client
These terms govern the website. They do not govern the software you subscribe to. If you have accepted a BlueArc proposal, the supply of that software and the services around it is governed by our Terms of Business, and where those terms and these ones differ on the same subject, the Terms of Business apply to that engagement.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and you agree to submit to the non exclusive jurisdiction of the courts of New South Wales.
11. Changes to these terms
We may update these terms by posting an updated version on this site. Continuing to use the site after a change means you accept the revised terms.
